Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Authentiq platform, websites, dashboards, and API (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.

2. Description of Service

Authentiq provides AI-powered analysis of images to detect filters, AI-generated content, deepfakes, facial manipulation, and liveness, and to compute an advisory authenticity score (the "Authentiq Score"). The Services are offered across consumer and enterprise tiers with optional programmatic access.

3. Accounts & API Keys

You are responsible for maintaining the confidentiality of your account credentials and API keys (including keys prefixed aq_live_ and aq_test_) and for all activity under your account. Notify us immediately of any unauthorized use. You must provide accurate registration information and keep it current.

4. Acceptable Use

You agree not to use the Services for any illegal, harmful, or abusive purpose. In particular, you must not: (a) attempt to re-identify, surveil, or unmask individuals from analysis outputs; (b) use results to engage in unlawful discrimination or to deny rights, benefits, or opportunities in violation of applicable law; (c) upload content you lack the rights or consent to submit; or (d) interfere with, reverse engineer, or circumvent the security or rate limits of the Services.

5. Plans & Billing

Paid plans are billed on a recurring subscription basis through our payment processor, Stripe. Plans include a monthly allotment of analysis credits; usage beyond your allotment may incur overage charges at the rates shown at purchase. Fees are non-refundable except as required by law. You may cancel at any time, and cancellation takes effect at the end of the current billing period.

6. Intellectual Property

The Services, including our software, models, and branding, are owned by Authentiq and protected by intellectual property laws. You retain ownership of the images you submit. You grant us a limited license to process those images solely to provide the Services. We grant you a non-exclusive, non-transferable license to use the Services in accordance with these Terms.

7. Disclaimers

The Services are provided "as is" and "as available." Image analysis is probabilistic and AI-based; results are estimates and are not guarantees of authenticity or manipulation. The Authentiq Score is advisory only and should not be the sole basis for any consequential decision about a person. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, Authentiq will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability for any claim relating to the Services will not exceed the amounts you paid to us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Authentiq and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees, or use the Services in a way that creates legal or security risk. Upon termination, your right to use the Services ceases, and certain provisions survive termination.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Authentiq is established, without regard to conflict-of-laws principles. The specific governing law and venue should be finalized by counsel prior to production use.

12. Changes to These Terms

We may modify these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
